Does Your Handbook Need a Hand?—New Scrutiny from the NLRB Requires Immediate Changes to Non-Union Employee Handbooks
Presented by Luther Wright, Jr., OF Counsel, Ogletree, Deakins, Nash, Smoak & Stewart, P.C.

In many unfair labor practice investigations today, NLRB Regional offices require non-union employers to produce their employee handbooks, even when no handbook rule or policy is at issue in the underlying ULP charge. The Regional offices are closely reviewing the entire handbook for “technical” violations of the NLRA based on vague or imprecise wording. The NLRB may then issue a complaint focused on that technical violation, even when there is absolutely no evidence the challenged rule has been enforced in an unlawful manner – or enforced at all. Unions are also using the NLRB’s findings strategically in campaigns, frequently citing alleged unlawful handbook policies to support election objections after losing a certification vote in order to obtain a new election.

For these reasons, it is critical for non-union employers to review their handbooks carefully. This seminar will discuss needed changes to Employer Handbooks in the areas of: 1) At-Will Employment Disclaimers; 2) Respect in the Workplace/Anti-Harassment Policies; 3) Dress Codes; 4) Off-Duty Conduct; 5) Confidentiality; 6) Solicitation and Distribution Policies; 7) Computer Usage; 8) Social Media; 9) Media/3rd Party Contact; and 10) Use of Logos and Trademarks. The seminar will explain why changes to employer handbook policies are necessary based on NLRB precedent, explore common mistakes that employers are making in their drafting and implementation of handbook policies and recommend best practices and practical strategies for avoiding NLRA violations.
